Supreme Court Issues Orders Concerning Lawsuits

Two Orders are with regard to the Right-To-Work suit and the 4% pay deduction (pension) cases; the Supreme Court agreed to hear those two cases together because they have a common issue; i.e., what is the Legislature’s authority vs. the Civil Service Commission’s?  Oral argument dates have not been set.

The third Order concerns the MAGE 3% pay raise case.  The Court decided to hold the State’s application for leave to appeal in abeyance, pending the outcome of the other two cases, because it’s decision in those two cases might affect its decision of the MAGE case.

It is not immediately apparent to MAGE legal counsel how that would be since the MAGE 3% case does not involve a statute that is contrary to the Commission’s authority.  Nonetheless, the MAGE 3% raise lawsuit is now being held in abeyance pending the outcome of the Right-To-Work suit and the 4% pay deduction (pension) cases.
